2 · Applicability

  • These terms and conditions apply to every offer by BYYANA and to every agreement between BYYANA and you as a consumer.
  • By placing an order via our website, you agree to these terms and conditions.
  • Deviations from these terms are only valid when agreed upon in writing.

3 · Offer and orders

  • All products are offered while stocks last.
  • By placing an order, you make an offer to purchase the product at the price and under the terms stated at that moment.
  • BYYANA may refuse or cancel an order, for example in case of an incorrect price, stock issues, incomplete information or suspected fraud.
  • The agreement is formed as soon as BYYANA has confirmed the order digitally.

4 · Prices and payment

  • All prices are stated in euros (€) and include VAT, unless stated otherwise.
  • Shipping costs are clearly displayed before you place your order.
  • For the Netherlands, shipping costs are € 6.95. Shipping is free for orders from € 69.99.
  • For Belgium, shipping costs are € 10.95. Shipping is free for orders from € 99.99.
  • Your order will be processed once the payment has been received successfully.

5 · Delivery and shipping

  • Orders are usually processed and shipped within 1 to 2 business days.
  • The expected delivery time is stated with the product where possible.
  • BYYANA ships to the Netherlands, Belgium and other countries where delivery is available.
  • Once your order has been shipped, you will receive a confirmation by e-mail.
  • Once your order has been shipped, we can unfortunately no longer change or cancel it. If you do not wish to keep the order after receipt, you can register it for return in accordance with our return policy.
  • Delays at the delivery service may occur. BYYANA cannot be held responsible for delays beyond its control, unless the law provides otherwise.

6 · Right of withdrawal and returns

  • As a consumer, you have 14 days after receiving your order to withdraw from your purchase.
  • Would you like to return something? Report your return within 14 days of receipt via the contact form, WhatsApp or by e-mail. Include your order number.
  • Cosmetics can only be returned when the product is unopened, unused and fully sealed. Once the seal is broken or the product has been opened, it cannot be returned for hygiene reasons, insofar as the statutory exception for sealed hygiene products applies.
  • Sale items can be exchanged for another item. Refunds are not possible, insofar as legally permitted.
  • Return the product preferably in its original packaging and make sure the product is not damaged.
  • The costs of returning the item are at your own expense, unless BYYANA is legally obliged to reimburse these costs.
  • If you are entitled to a refund, the amount will be returned via the same payment method you used.
  • BYYANA may postpone the refund until the returned product has been received or until you have demonstrated that the product has been sent back.
  • If a product has decreased in value due to use or damage, a reasonable reduction in value may be deducted. This does not apply if the product was defective or delivered incorrectly.

7 · Warranty and complaints

  • All products are covered by the statutory warranty. This means a product must meet what you may reasonably expect from it as a consumer.
  • Is something wrong with your order or product? Please contact us as soon as possible.
  • Complaints about the performance of the agreement can be submitted in writing via e-mail, WhatsApp or the contact form.
  • BYYANA tries to respond to complaints as soon as possible and at the latest within 14 days.

8 · Liability and use

  • Our cosmetic products are exclusively intended for external use and must be used according to the supplied or indicated instructions.
  • Keep cosmetic products out of the reach of children.
  • Always read the instructions and product information before use.
  • If in doubt about a product, it is advised to first test a small amount on a limited skin area.
  • Stop using the product immediately in case of irritation or an allergic reaction.
  • BYYANA is not responsible for damage caused by improper use of a product or failure to follow the instructions.
  • Minor differences in colour, shape or appearance between product photos and the actual product may occur, for example due to screen settings or manufacturing.

9 · Intellectual property

  • All texts, images, logos, designs, product names and other materials on this website are the property of BYYANA or are used with permission.
  • It is not permitted to copy, distribute, reproduce or otherwise use these materials without prior written permission.

10 · Privacy and data protection

  • BYYANA processes personal data in accordance with the General Data Protection Regulation (GDPR).
  • Personal data is used for processing and delivering orders, communication with customers and, where consent has been given, marketing.

11 · Force majeure

  • BYYANA is not obliged to fulfil an agreement in case of force majeure, when fulfilment is reasonably impossible as a result.
  • Force majeure may include, for example: extreme weather conditions, pandemics, transport strikes, failures or other circumstances beyond BYYANA's reasonable control.
  • As soon as the force majeure situation has ended, BYYANA will resume its obligations as soon as possible.

12 · Disputes and applicable law

  • Dutch law applies to these terms and conditions and to all agreements between BYYANA and you.
  • Disputes will first be addressed in mutual consultation.
  • If a dispute cannot be resolved mutually, it may be submitted to the competent court, subject to the statutory rules that apply to consumers.

13 · Changes

  • BYYANA may amend these terms and conditions from time to time.
  • The most recent version is always available on the BYYANA website.
  • Changes apply to orders placed after the date of the change.
